Filing a Priority Notice
Downloads
If the applicant wishes to notify the Authority of their intention to make an application to enter a mortgage in the register, which may be done by or on behalf of the mortgagee, a "priority notice" may be filed. Such a notice when filed is assigned a number, date and time of filing and the applicant so notified.
The priority notice is valid for a period of 14 days from the time and date of register which implies, that if the actual mortgage is registered within that timeframe, it will be considered to have been registered from the original date and time of the filing of the priority notice. If the mortgage is not registered within the 14 day timeframe, then the notice of priority will be considered to have expired and a new notice will have to be filed.
